I have couple friends who moved to Australia 3-4 years back, they love it. they mentioned that they have already applied for citizenship. 3 years back we decided against migrating there because our PD was almost current, we are still waiting. :)

Here is my recent experience,
in the month of april my wife and I had received RFEs for 325 and birth certificate, we submitted the evidence and there was soft LUDs for almost a week, case status said a decision will be made in 60 days. I t is more than 90 days, so I called up the customer service (I very well know that they can't issue GC as the priority date is not current) I spoke to her as a layman and filed for a service request. Here is the email that I got:

I understand it is a mess and I never suggested it should not be solved. However, I know a lot of my friends in PBEC who will apply PERM (pri dates 2003/04) if the pri dates for India became current.
And I am myself stuck in Dallas BEC which is not even taking a look at State cases. And yes, if EB2 became current, I will file another labor in a jiffy. So, yes, it is a mess there but we got to look for avenues out of it.
I am , in no way, suggesting that we should not support PBEC overhaul if thats what it takes to get labor approved. But right now, Comprehensive Immigration bill is about GC and H1 numbers for us, it will not deal with labor backlog, USCIS backlog etc. So, what do we do now - should we raise an issue that politicians will hear, but not act on, or do we raise a red-hot issue of what hard country limits will do and there is a fair chance it might be acted upon?

So gc101 would be safe if his PD becomes current before his file is pre-adj or get's stuck (!) in something like FBI namecheck after pre-adj. which might allow him time to add his wife's name.
So, what you mean is, I would be better off to hope that my name gets stuck somewhere in the namecheck or RFE or something for me to have enough time to get my spouse added in time BEFORE my I-485 gets approved. Did I understand it right?

Even if the Labor cert says "Masters" then as long as you had BS + 5 years experience before you filed for labor, to qualify for EB2, this should be ok. Unless the BS was a three year degree and you did not have the required experience.
From USCIS perspective to qualify for EB2 you should be Masters or BS +5 experience.
I think if this is true you have a good chance to fight this.
Looking at the Labor cert , it says "Masters degree" and NOT "Masters or equalent". that might be the caused the I140 denial .
Any one had this situation before ?

I haven't applied for green card yet. Is IV only for GC purposes or it addresses other issues too which makes life of H1b holder hell?
Not sure why you would generalize all H1b holders as experiencing hell - I for one did not. Anyways if you take the time to browse the forums you will find the answer to your question.

Most people has very misconception about "parole". It is not a free/flexible travel document like visa. As a AOS applicant, one should not leave US till it is approved/denied. One MUST present in US during AOS. The parole is only for any emergency purpose; which is similar to prisioners. As USCIS is flexible, in approving the AP, the people don't realize the travel limitation of AP. They are travelling on AP for vatation/fun etc.. As per law, the AP is not intended for it. The CBP officer was right in asking the legitimacy of the travel. The AP document clearly says it is based on "humanitation" admission to retrun after an emergency travel.
Technically, you are right. But on the other hand, it was at a time when one had to wait at the most 6 months for AOS.
But, for people from India, on EB categories, the wait is not months, its in YEARS. So, its irrational to go by whats written there.
On the other hand: I think we must request USCIS to recognize this underlying problem with EB folks that are primarily from India. They must print an exception on the AP for India and exclude the wording "for emergency purpose only". I don't know if USCIS has the discretionary power to amend minor changes.

I am in a unique situation and your valuable advice is highly appreciated. I worked for company A for 3 years and filed my 140 and 485(july 2007). I quit the company in may this year and joined another company. My 140 was approved on 06/16/2006. recently my previous employer revoked my I-140. I got a notice from USCIS that my I-140 and I-485 has been withdrawn. As per my new attorney since i meet all the conditions for job porting (180 days, 140 approved, and same job profile), no one else other than me can withdraw my I-485 application. my attorney filed an MTR today. Can i work while my MTR is pending. Is Withdrawal acknowledgement notice is same as denial notice ? please help

Yes, flight to DC would have been then recovered from USCIS in the lawsuit against them.. :)

On a serious note though, flight ticket is a small price to pay compared to the other losses that we are suffering because of status quo.
