Hello,
Could someone please give me the advice on following concerns.
I have filed my I 485 2.5 years back and got into retrogression, got married about a year back and my wife is in US on H4 as I am maintaining my H1B visa. My questions are
1) Is it possible to file derivative I 485 for my wife myself withoug going thru attorney as I dont have any attorney currently.
2)If my I 485 is approved before I file my spouse I 485, is it Okay to file I 485 for the spouse as normal case ?

We can look at overtime work done by uscis and draw an estimate what it take for them for processing our 485 this october. Then we could send Pizza for overtime workers.

I am really apalled by the ppl in this thread who are saying don't complain about BEC. Their reaction can be summarized as follows:

There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. Please contribute and incrase the membership of IV for the good of all of us.

No. You got me wrong. I have friends filing through consulting firms. You got me wrong completly. Outsourcing/offshoring firms are completely different from Consulting firms. Consulting firms files new h1s and get the people here to work for their clients. This is good to new prople who wants to come here legally, to US busincsses and to everybody (except for anti-immigrants). But Outsourcing/offshoring firms file lot of H1s and do not use them. Thats the problem. If they use, it is not going to be a problem.
Second guess: You have a US degree or you are not working for a conslting firm.
This is also wrong. I don't have any US degree. Also, I am working as Consultant from past 3 years. I worked with different big clients as a conultant. This is how it works in US. Again, Consultancy is different from Outsourcing/offshoring.
Why do you think the spouses on H4 do no deserve H1? If they want to work, why do you think that they should not compete in the job market?

BTW, the companies you are cursing, TCS, Wipro, Satyam etc., it is possible that soon the H1s applied by these companies will be exempt from numercial limit. Yes, you heard me right. No firm is going to waste the money by filing H1 and not allowing them to work is US after getting it except for Outsourcing firms. It is a fact, agree it or not.

I am sure it was exciting news for us to hear. However, it appears the Immigration provision were removed before passing the bill. This is another proof that the IV core are right on track. It appears like they have good information and that immigration-related bills and changes will be passed in immigration bill itself and not attached to other bills. I think the congress will address the all the immigrant issues in a new CIR or some new immigration bill.

EB3 ROW is at Jun 2004. But as per latest USCIS inventory, EB3 ROW pending 485's are around 48,000. Visa numbers available every year for EB3 is approximately 42k. If you deduct the backlogged EB3 countries (4x3000) visa numbers, the total comes down to 30k for EB3 ROW. So EB3 ROW should become current or atleast Jul 07 in another 1.5 years. If this is not going to happen, it means they are diverting the EB3 numbers to some other categories.

I was curious too about EB3 ROW not progressing. The only explanation could be that there were lot of consular cases with older PDs. (Or USCIS chose to ignore EB3 altogether. Remember the couple of hundred EB3-I visas wasted by USCIS recently.)

I was curious too about EB3 ROW not progressing. The only explanation could be that there were lot of consular cases with older PDs. (Or USCIS chose to ignore EB3 altogether. Remember the couple of hundred EB3-I visas wasted by USCIS recently.)

For EB3 Folks with PD's in early - 2003- there are close to 8742 applicants in front of you That is a wait of 5 more years.
For EB3 Folks with PD's in mid 2003 and later - There are 14583 applicants in line before you- That is a wait of 10-12 more years.
Now the only way forward will be to lobby with IV for a legislative fix. Apart from that there is just no option, the sooner people realise that and help IV with advocacy, the better results we will get.

I would say 90 % in the same boat :p No sweat. They will do an immunization test. You could even get the vaccinations taken
I am sure some of us do not have vaccination records, but have gone thru vaccinations back in India....The record keeping is a recent phenomenon...any body in the same boat and have gone thru same phase
