    Does anyone know whether hard copy of Labor approval is required for filing Form 1-140. My Labor status shows certified, but my lawyer is conveying that they have not received my hard copy of approval to process Form I-140 and 485. Can some one tell me if we can take a print out of Labor approval from online status and use it for filing 140.

    Yup...according to my lawyer, hard copy is required. I had all my paperwork in by the 22nd..and the reason they did not file on Friday for Monday delivery was that there was no Labor copy. Luckily the labor arrived on Friday...but then my case got pushed behind others...

    Did you get copy of approval notice for I-140? I mean I-797 approval notice for I-140.

    I got only I-140 application copy with labor and not the approval notice with the help of FOIA.

    Thank a ton for the help, Can you please tell in more detail what i need to do/say there? I have heard that people are being turned back pretty rudely at local offices. Also do i need to fill any forms before i go there?

    Local Offices will no longer accept and adjudicate Form I-765 for an Interim EAD. The Service Centers or NBC will be responsible for adjudicating the pending I-765 and issuing interim or non-interim documentation. Upon receipt of Form I-765 requesting an interim EAD, local field offices are required to perform the following tasks.

    � CLAIMS Verification
    o Underlying application remains pending
    o Determine if RFE has been issued, thus tolling the 90-day adjudicative requirement
    o Form I-765 remains unadjudicated
    o Biometrics have been captured�if not, refer to ASC
    � Contact NBC or Service Center to initiate EAD production�either Interim or Non-Interim
    � Provide Notice to applicant acknowledging status inquiry.

    5&6 raise an important issue - Could there be potential EAD and AP time lost between the actual approval dates and by the time these documents reach us in the mail?

    Guys, as we all know we can not build our careers on EAD and TD. For a permanent solution, join us in the DC rally!



    This is what happens after 485 receipts.

    1. If one has not applied for EAD and TD , one applies for them and wait anxiously for their receipts.

    2. Meanwhile some people start getting FP notices and one does not receive them he or she gets anxious. Finally one gets FP.

    3. Meanwhile one gets the receipts for EAD, TD. One keeps checking the status online.

    4. One goes and gives finger prints for INS.

    5. Finally one gets his or her EAD and TD after 5 to 6 months , One enjoys the moment briefly.

    6. Its almost a month since one received EAD and AP , Its time to apply for renewal.

    7. Repeat step 1

    8. Its almost 15 months since the first FP and one receives the second one because "Finger prints expire" ,


    One has to repeat these steps in a cycle for almost 6 to 10 years depending on PD and "Nationality"


    Meanwhile if USCIS changes any processes anywhere in the pipeline expect further delays.


    I think best thing is to do participate in IV activities.

    as far as I know, you paying for H1b is not correct and is illegal and they will be accountable for this. Secondly, I heard the contract dont stand in court, especially when they are rude.

    I think you have an option to report this employer to DOL/USCIS, for charging you the H1b expense. Companies should sponser H1b only when they genuinely need and can pay for the expense!

    I am not a lawyer, so I recommend you consult one. Also feel free to communicate this issue to your employer and I guess you will be on your own!

If there are majority Indians on IV board, it is not a crime but it is obvious. Some of my chienese friends on IV board may start thread for wishing chienese festival, I bet most Indians on this board will welcome and same goes with Muslim friends on IV board. Starting and wishing ED MUBARAK thread (By the way that is also a Indian tradition..And I am proud of that too) is not a crime and by now if nobody started it does not mean other people may not welcome it. If you are a Muslim, start the thread for ED Mubarak, I will be the first to welcome that step. You want to be American,, right? Then first start learning open mind and start respecting the culture of majority IV memebers first. If you would not start that now how will you settle yourself in cultural pot of the world?

    If you are an Indian citizen right now take control over your inferiority complex and get over it because if you do not respect your culture or your tradition what guaranty would be there for Americans that you would respect American traditions in future.     Is there any Specific date, I mean when AILF is filing the case...USCIS is announced they are gonna reject the applications..but did they rejected any single application?? We will come to know after 4 or 5 weeks abt our applications (As per USCIS rep)....I think there must be some time limit to file a case...and we dont have a base to file a case until they reject it.

    Finally they dont reject application nor they will accept it...

    Hello Guys,
    I need your advice here. Six month ago i joined one of the many blood suckers -Desi cosulting company in new jersey. As you all know, they ask me to sign their contract in which its mention that if i leave their company before 1 year then i need to pay them 15k. Thy also charge me 3k for my H1-B which i am still paying everymonth from my paycheck and we have 70/30. In just six months i am so much fed up with them. These people are so rude...always show their arrogance over phone. I have no libarity to find job by myself. They always looking for higher pay rate sp that their big money tummy get filled up.and i also feel that they didnt told me the right pay rate for the project i am working on right now.


    I really want to leave them, Even before 12 months. Is there any importance of that contract letter i signed with them?. Can they Sue me? What are my options? Please suggest me.....i am in stress.

    If you are unhappy with this employer, you always have a choice of finding a different one, but there is no guarantee that the other one is also not a blood sucker. This situation will continue until you depend on the consulting companies (especially DESI) for your H1B and GC needs.

    The best option is to find a full time job with a reputed company and stick with them until your GC is completed or until you get to the point where you can use AC21, nowadays lot of companies are processing H1. Check the visa database to find the information regarding the employer you are interested in.

    Don�t just choose the employer based on the attracting benefits they offer. Conducting some due diligence will land you at the right company.

    BTW, what do you mean by �you have no liberty to find a job�? All you need is internet and a phone to talk to people.
    Lot of people including myself has been through this nightmare, believe me it�s not so difficult.

    What is your understating on money return on whole life ins. plocy?. do you think you can cancel at anytime and get back your premium or withdraw portion of your investment?

    Does anything mentioned on your link about policy surrender or money withdrawal when policy is in force? please search more and post here....

    As far as I know whatever premium you pay is gone when you cancel the policy but if the policy has cash value then you get that amount.
