Why there is no green light on green cards?

There have been lots of discussion and spotlights on H1-B issues in the past. One of the least heard, but the most pressing issue that continues to plague day-to-day lives of thousands of high-skilled legal immigrant workers in the US is Retrogression causing deep anxiety, frustration and considerable delay in processing and approving of permanent residency, also called Green Card.
For employment-based green cards, every country has a fixed number of immigrant visas or quota on a per-year basis. When I-485 adjudication or adjustment of status from non-immigrant to immigrant status (example H1-B to Permanent Resident) successfully concludes, it leads to approval of green card. This approval requires a visa number to be available. But, if the visa quota for a country has been used up, visa numbers become unavailable for that country. This unavailability of visa number is the effect of retrogression, wherein, the US Department of State, based on the current demand for the visas decides allocation of how many visa numbers can be released to meet the demand and be in conformance with the pre-set quota.
Employers file for green cards for skilled professionals to obtain a legal immigrant status for future employment. Skilled professionals who have green card processing pending typically wait for their green cards to be approved for an average period of 5 years. During this period, they have very limited, if any, freedom to exercise choice with changing jobs, or getting a raise or promotions, being with the same job, title, position and employer with no way out until it gets approved. The only way out would be to risk losing your green card or having to start all over again. Family members of such skilled professionals share the pain as well. Spouses who would like to obtain jobs and attain financial freedom do not have the legal rights to work until they at the least have an employment authorization. Children of such professionals who apply for college cannot benefit from federal government loans, but instead need their parents to seek private loans. Becoming a legal immigrant has become an increasingly challenging and frustrating experience as has been noted by the experiences of each individual of this community. Unless a legislative reform is made, green cards are not only going to be tough, but also seemingly impossible to materialize.
Immigration Voice, a non-profit organization in the US, founded in Nov 2005 has begun grassroots level effort to alleviate the untold sufferings of high skilled professionals and has been working actively through volunteer members of the organization, that has grown to 9,000+ members in just more than a year. Immigration Voice recently hired Patton Boggs, a top public affairs firm for lobbying efforts towards the immigration goals of the high skilled worker community. Immigration Voice is now heavily engaged pursuing CIR or the Comprehensive Immigration Reform which will be introduced in the Senate in early March 2007 and then proceed to the House before it will be signed by the President to be enacted. This may very well be the ray of hope for the thousands of immigrants stranded on the not-so-green-now land of green cards.

Whether we like it or not...this is a reality. I have had a neighbor where both the husband wife was working. They brought their parents every year... because it was cheaper than Day Care.
But they didnt bother to drive Benz and BMW.
True, have seen many folks do the same.

They have stopped issuing intrim EAD from local office.
According to this from Murthy:
Generally, one may apply for an interim EAD card, if the EAD application has been pending more than 90 days if there is not an unanswered Request for Evidence (RFE) on an I-140, I-485, or I-765 that is pending with the USCIS for the applicant. I diagree with you...Indian film Industry have very good directors, They are no way inferior to Hollywood. Firstly you can't compre them with Hollywood because they have differen audiances...Hollywood have money power so their movies are technically better, but as far as quality of movies Indian film industry is very good...It caters to all tastes. There are Shyam Benegal, Basu Chaterjee, Govind Nihlani for people who like simple senseful movies there are Karan Johar, Yash Chopra, Mani Ratnam for expensive, hip hop movies. There's RGV, Hirani, Rakyesh Omprakash Mehra for different story based movies. In my opinion caters to wide variety you need to pick up by your taste...None of the Amitabh Bachans did any thing for slums,Danny Boyle Made a very good movie.I think the fact is Rehman is a prodigy no doubt about that, he makes very good music we all know that.As compared to Hollywood directors Bollywood directors are subpar with the exception of very few good ones. Movie business is controlled in India by few families,what ever the movies they make rest of the people will watch it.I dont want to open the bollywood can of worms.Movie directors in India are usually sons of Bollywood actors or some one related to Bollywood.

Currently AILA is reporting that there are two bills pending for Employment-Visa Recapture.
1.Reuniting Families Act (S. 1085) Introduced in the Senate(*)
2. Senate Judiciary Committee to Hold a Hearing on the Uniting American Families Act(**)
Reference-(*)(**) www.aila.org/
The S.1085 in the US Senate caters to specifically recapturing visa numbers for employment based category; i.e. ALL lost visas from 1997-2007 in the employment based category.
Also to remember is that re-captured employment based visas can only be used in the employment category. They CANNOT be used; repeat CANNOT be used in the Family category; however the vice-versa is true; i.e. unused Family Visas can be used in the employment category as happened last year 2008.
The second bill Uniting American Families Act is in the US House. Though the intent of this bill is not the same as the senate bill S.1085 noted above; an amendment can be made to make it the same. Currently, they are scheduling a House hearing on 3rd. June, 2009 for that bill.
We need HIGH level of action on the above two bills from IV Core and the Community; because of two reasons-
1. Adminstration has CHANGED; so one cannot assume that things which happened in past years will be the same. i.e. No action will be taken by lawmakers on the Immigration front. Remember it is the Democrats and we are back in the good Clinton year politics (which passed AC-21).
2. We need our Green Cards soon. India is the ONLY nation where 80% of EB folks are waiting for two years or more after I-485 submission, given security checkas and pre-processing has already been made for applications pending for two years.

Spouse working - Yes, in theory they could allow H4 to work. However would that be any job? If so then the H4 would actually be far better off than the H-1B who is restricted by job category and employer qualification
Long term - Yes, in theory, a 20 year H-1B takes some of the stress off. But what of Citizenship? If you stay 20 years you'd want to at least have the option of becoming a US citizen. At present I believe only a GC holder has the option to progress to citizenship.
Employer based - This is the key. Unless an H-1B is no longer employer sponsored but self-sposored then the H-1B holder is still living on a knife-edge and can be sent back home at any moment if their employer fires them or goes under and they cannot secure another similar job quickly enough.

Do you have to go thru an accountant to start a company?
I started an LLC earlier this year. Much easier and less risk with an LLC. It is still early to say whether the company will make it to higher grounds or not. But I sure am trying. I have me and my wife as manager members. No employees at the moment.

Pls post a confirmation on this thread that you have emailed the editor so that we know how many people sent emails. We need more participation from our members on such tasks in order to highlight our issues in the media. We find a lot of people posting messages about what we ought to be doing on the forum but only a handful actually do when we urge members to do. Any efforts to get attention from media to highlight our isues will be highly appreciated.

Lets hear em.
I feel lobbying is the best way followed by occasional rallies.
And we need to do some high-profile lobbying. Like get the big companies involved. I hear these big companies have their own lobbying manager (Google has them) working full time. And they have deeper pockets than our $20 or $50.
