isnt a visa number assigned when they apply for 485?
good point in item 4. When i talk to people from other countries about visa issues and IV they just look at the processing dates for 485 and think that GC will be approved in 6 months.
Please remember that even if BEC clears the application with 2001 priority dates. These people still need to:
1) Apply for I140
2) Have I-140 Approved
3) Apply for I-485 only if their priority date is current
4) Complete various I-485 tasks like fingerprinting, BACKGROUND CHECKS (this is a huge one and unless you are lucky you can get stranded for anywhere between 6 months to 3 years)
5) Now after completing 1 - 4 above you can expect that they will apply a visa number to the application

Many of them were not confident of clearing labour on their own credentials ( BSC Zoology, BBA, BCOM etc..) or probably wanted to jump the line.
don't you think they will face problems in 140 if their education doesn't match that in labour... its not as easy as you told..
jumping the line part i understood. but the first part of your quote is not true...

ramus, follow my posts in the past 20 days and you will see i have posted many posts for this AP expedite. I have a travel coming up shortly and I had only exactly 90 days from the date of application and date of travel. My application was approved recently along with my spouse. There is even a post where I listed out all the steps I took to expedite and finally finally only the local congressman phone to USCIS helped. its just unbelievable, but its possible. I have tickets that even if you postpone the journey I will lose money. I said to myself enough we lose with USCIS, and so decided to take all and any steps to expedite and get it done. just follow my posts (like start reading my past 20 posts) and I am sure you will find it useful. If you need more help, please PM me, and I will be more than happy to help you with any questions that you have. All the best.
that's what happened with us as well.. Waiting for 80 days now on AP and already changed the tickets twice..

LOL. This thread again...
They gamble, they lose and then they whine about rules being unfair here.
And this willwin guy has the nerve to give me a red mark on my post saying I'm not being diplomatic... like I care about being diplomatic when they want IV to shift its primary focus in order to cater to such ridiculous asks!! If I wanted to be diplomatic, I'd have come here on foreign service.

The best thing DOL did was to get rid of Labor Subs. Period.
Why:
1. I've paid Social Security taxes + Medicare + Income taxes longer than people who've come here in 2006 and used LS. If I don't get GC (frustration due to retrogression), aren't these guys enjoying (or going to enjoy) benefits that I've paid for, for a longer time.
2. It's really no different than the system in India (or what used to be)for getting everything from telephone, passport etc. where a select few jump ahead in line by either knowing somebody or paying somebody. Isn't that one of the reasons a lot of us decided to move to the US for better(fairer?) opportunities.
3. Isn't this very similar to the falsifying of experience people do to get better positions in a company?
4. Yes, I do have a problem if after slogging my butt off to get a Ph.d, somebody with 3 yrs + 2yr of NIIT comes in through desi consultancy and gets far ahead in line than me. Now before somebody says NIW+ EB1, let me tell you that it's not that easy to get it in the Computer Sciences.
Anyway, having said that it's no time to be divided, but to present an unified front in getting legislation passed that eliminates exactly this kind of discussion. Atleast 20 yrs down the line when we talk about arranging marriages between our children, let how we got GC be a deciding factor in who's got the bigger status :D

Nice take on the situation.
I am very surprised about the requests for cheap photos !!! What a pity.
We were ready to spend thousands of dollars just a month ago just to have the ability to apply for I485, but when you get a chance , try to save a few dollars and risk an RFE , delay in processing or even denial.
Walmart photos suck , so are CVS photos. I had them take my pictures in the past. Never used the walmart ones and CVS photos got rejected for visa revalidation. They used Polaroid camera at walmat and they were not good at all.
I took them at Macy's studio , costed me about $30 for 6 copies but they are great. Please choose a professional studio, $20 extra dollars are worth every penny.
Some one mentioned about saving $20 and have a dinner. I would rather have peace of mind knowing my pictures are good enough for USCIS than have a $20 dinner.
Just my 2 cents though. May be I am extra cautious because I got burned once :)

Everything filled up including masters degree H1. All big lotto
WASHINGTON U.S. Citizenship and Immigration Services (USCIS) announced today that it has received enough H-1B petitions to meet the congressionally mandated cap for fiscal year 2009. USCIS has also received more than 20,000 H-1B petitions filed on behalf of persons exempt from the cap under the advanced degree exemption. Before running the random selection process, USCIS will complete initial data entry for all filings received during the filing period ending on April 7, 2008. Due to the high number of petitions, USCIS is not yet able to announce the precise day on which it will conduct the random selection process.
USCIS will carry out the computer-generated random selection process for all cap-subject petitions received. USCIS will select the number of petitions needed to meet the caps of 65,000 for the general category and 20,000 under the advanced degree exemption limit. USCIS will reject, and return filing fees for all cap-subject petitions not randomly selected, unless found to be a duplicate. USCIS will handle duplicate filings in accordance with the interim final rule published on March 24, 2008 in the Federal Register.
The agency will conduct the selection process for advanced degree exemption petitions first. All advanced degree petitions not selected will be part of the random selection process for the 65,000 limit.

Not only that, USCIS or any other govt. agency can make rules and make them effective retroactively. In other words, they can come up with a final rule in July 2008 and can say that this rule is effective July 2005.
That is why, I call GC a game where if your opponent feels that he is losing, he can change the rule of the game on the fly.
It looks like USCIS can make any new laws or change rules of game anytime. They live by their will.

hi, just now both the faxes sent. one more small suggestion, correct me if i am wrong, also in addition to contacting the employers, can we contact good immigration lawyers like Berry Appleman and Leiden (www.usabal.com), rajiv khanna, murthy.com, sheila, aila.org, ohio immigration (www.immigration-law.com) etc and ask them to send this fax on their letter pads on behalf of IV. my 2 cents..
thanks.
thanks.
