My PERM was filed in Dec, 2006 and was denied on April, 2007. As per my employer's lawyer it was erroneously denied by DOL. The lawer has received the denial letter but no reason was stated. He was keep on follwing up with DOL but no answers. On Aug 2007, lawyer was followed up again directly with the DOL office in Atlanta , with the liaison at the American Immigration Lawyer's Association and also it was sent to the congressional office. Through Senetor we came to know that there was typo in the date field. The lawer is persuingto get the denal letter again with reason so that we can appeal. But we have 10% to get another deial letter. Now layer is asking for fillin a ner PERM. Inbetween I lost 8 months and now I'm running out time. My 6th year is expiring on Sept08. Just incase if we din't get denial letter and file the new PERM on Mrach can we get the 7th year extension ? (We will show all the documents etc for previos denail case and there was no reason in denail letter. PLEASE HELP.

Here is what I wanted to request / share with you:
1. The advocacy related information is is "red" font. I think red font is normally used for the "donor forum".
2. As such I was looking desperately for information aout advocacy, without trying to "click" on the available thread links, just because it is provided in red font! This question has been posed before but I did not find answers so am posing too: When can one travel safely to India after applying 485?
1) If EAD and AP are filed along with 485, how long will they take to arrive. Service center dates indicate that EAD and AP currently at Jan 07. Does that mean that they are taking over 4 months to issue EAD/AP?
2) There is a an Interim EAD. Is there an interim AP if AP is pending for over 90 days?
3) Is it possible to request EAD/AP at a later time?
4) My H1B is up for reneval in Oct 07. Can I get a 3 year extension on H1, apply for a H1B visa in India and travel back to US on this? Would this be a faster option?
5) When do FP notices typically come out after applying for 485?
6) What is the grace period for FP if one misses the deadline (Is it still 12 weeks? Will the new rule to remove 12 weeks on RFE/NOID have an impact on FP?
7) If you are using an attorney for 485, will all such notices (FP, etc.) go to the lawyer as well. The concern here is that if the notice comes to my home address and I am out of the country then I am liable to miss that appointment.

78th day and counting....
I e-filed on May 22... FP done. No LUDs
One of the service reps was kind enough to send an expedite request on my behalf. No updates yet on that.
Planning to contact local congressman this week.
This is all so frustrating.. We were waiting for GC now wait for EAD too!! :mad:
My EAD is expiring on Sep 22... and to top all this, my DL is based on EAD.. so from Sep 22 I'll be sitting home doing nothing... :eek:

This morning I spoke to one of the Second level officer to get the SR done as I hit 90 days today, but he rejected saying they can not create as I am still with in the April 16th processing timelines. He wanted me to wait till I get my Eapedited request answered.
He is saying interim EAD can requested only if the posted processing timelines exceed 30days to our Filed date. Ridiculous. I told him, how does it matter what processing timeline TSC posts!, as per the memo if I have been waiting for more than 90days am allowed to request an Interim EAD.. But he is not ready to listen.. He started saying those processing timelines are created based on the volume, so I am not allowed it seems.. BS... I wish I had told him to increase the GC quota as there is more volume.. brainless ppl.
They dont even understand what it means to loose the jobs coz of processing delays from USCIS. All the 6 years (H1 B) perid they wanted us to have jobs without any breaks and they dont care now!!

(1) How do I arrive at my hotel / place of stay in the DC metro area (VA/MD/DC)?
If you are flying into DC area (IAD/DCA/BWI) and are being hosted by a DC area member, please call your host and arrange for transportation. Most likely who ever is hosting you may be willing to pick you up from the airport. If that's not the case, please refer to instructions below.

BWI:
Option 1: Amtrak has daily service to Union station starting at $12. Keep in mind that Acela Express may have a higher charge than other trains. Go to the schedules tab on the home page linked above and chose BWI (Baltimore –Thurgood Marshall Airport) to Union Station, Washington (WAS) for schedules on the day and time of your arrival.
Option 2: Bus-Metro There is bus service from BWI to Greenbelt Metro Station and from there to downtown Washington DC. Cost of this Bus-Metro trip is about $7.
If you are staying in a hotel in the DC area, Call your hotel and find out what the closest metro station is to your hotel and what line it is on to and then refer to the metro map.
IAD: At the arrivals door 4, Wash flyer bus leaves to West Falls Church metro station (orange line) as per the attached schedule. Fare is 10$ each way and 18$ round trip.

DCA: Regan National Airport has a metro station that is on both Blue and Orange lines.

Metro has pre paid fare cards (DO NOT BUY SMART TRIP CARDS) vended by the automated systems and can be paid using Credit card or cash. One-way fare during time peak time from the suburbs to Union Station (Senate) or Capital South (House) is 5$.
You can get the exact fare from the wmata trip planner on Metro’s website. Charge your fare card with the money needed on the first time during the weekend to avoid standing in line during the weekday. On the three days, you will use the Metro at least 6 times. So please charge your fare card to 6 times the one-way fare between your stations.
(4) How early should I start every day?
Please do NOT underestimate the time it takes to get to the hill by Metro, then to the Situation room (if needed) and then your actual meeting. You will need to start 2 hours ahead of your meeting time from your hotel in the suburbs.
(5) Is there a hot line number where I can call for help?
Yes, IV will set up a hotline. 202-386-6250.
(6) What to say to the lawmakers in the meetings? How to put our point across?
A lot of this will be provided during brain storming sessions on Sunday. Please refer to the attached “How to Have a Successful Congressional Visit”
(7) Please tell me plans for the Sunday session?
Please Make sure you be there for the Sunday session. Sunday session will begin from 9:00 AM and will last till 9:00 PM. There will be several rounds of sessions lasting a couple of hours with breaks in between. You can attend any of these depending on your availability and arrival time. Use this day to also read the materials we would be providing you for meetings and ask us any questions you may have. You can meet others who would accompany you and brush up on talking points and plans for each meeting. We will also help you with some research on each lawmaker office. For example- position of the lawmaker office, voting record on past bills, issues championed in the past and present etc. Sunday sessions will be very helpful for getting fully prepared for next days of meetings.

I'm 06 and I know exactly what u r saying...Many 06 guyz got approved in 2008 but all those cases were from TSC where the processing times had reached 06. Freakin NSC was behind in processing and hence our cases were stuck. I'm assuming ur case is at NSC....
But come to the present day, everything is in place for our approvals. I'm confident v all will get it this time. Just a matter of time and its frustrating rt now...YES.
I went through the same frustration in 2008 when many 2006 got approved even when my date was current.
Looks like the same thing is going to happen again -- most of the approvals are from 2006 and I am still stuck forever..what the *&%^ing going on....
But come to the present day, everything is in place for our approvals. I'm confident v all will get it this time. Just a matter of time and its frustrating rt now...YES.

btw, which state do you live in? are they giving you 1-year DL's because of the EAD validity?
I did think about the above and my line of thinking was this ..once you have one year EAD ..get the drivers license (make and keep copies) and then start the above process.
what is the worst that can happen ..they will just return the same card ..ofcourse this is something which has not been tried out ..so we may have to call customer service and then see what they say ..any thoughts ??

Why not focus on the realities and likelihoods rather than fearmongering done by special interests, who send you information with secondary gain.

CSPA LAWSUIT TO BE FILED ON MONDAY

We will file our CSPA lawsuit on Monday. We have another plaintiff thanks to Atty. Andrew Knapp.
We hope that the USCIS, DHS and the Department of State will follow Matter of Garcia and apply the law not only to our plaintiffs but across the board.
Thousands of immigrants would benefit. We will post a copy of our complaint on our website later this weekend, and will discuss the lawsuit at the AILA convention next week, and in the upcoming issue of our free, e-mail newsletter.

Reading from this thread and few other, it is confirmed that in most cases, even if PD is current for a 485 filer, USCIS may not adjudicate those cases unless the processing time is reached. (There are few lucky applicants with PD 2005 and filed 485 after July 2nd and have already received their GC - but that is very few).
And most centers, they are processing Dec 2006 485 applications - a backlog of 10 months.
So, assuming that it may take same 10 months to process 485 filed in July - that is May 2008!!
With this, what are the chances of DOS making PD current for all EB categories again next June? They will do this to use all the VISA numbers for FY2008.
Or, if they don't want to repeat the confusions that happened in July 2007, to what dates will the PDs move (in June/July 2008)? Atleast to 2006?

Can you please let us know the procedure? I'm very much interested in filing a formal complaint with the CIS and Ombudsman. I'm not against genuine candidates getting their GC through MNC executive category, but would like to stop this malpractice.
