Hello friends,
My birth certificate has the following information
date of birth, Mothers name, fathers name, place of birth. It does not have my name and i am from India. Is it ok.. or should i get one with name.
My PD is not current but i am getting ready with all the documents, just in case it gets current.
I am in the same situation. My attorney advised me to have one with my name if possible. I scanned mine and my wife's Birth certificate and sent it to my Dad in India. He said that he will get the original in 2 days. Looks like it is a straight forward process. You could just send it with a copy of ur passport.
P.S: They would need the copies to be notarized before taking it to corporation or municipality

Hi folks, just as predicted, my email thread to select contacts resulted in one outright racist response. i dont want this group to get distracted or distressed if you too get such responses. take a look at the original note below and my response. remain brave. remain strong. this is a LEGAL immigration process in the US economic interest too.

it would be best that we not be on each others' personal contacts or have any future interaction at all.

I am expecting 2004 EB will be cleared this month. All the 2004 guys just relax and be easy ( particularly SOP ). Honestly i didnt care much before, there are million things better than gc in life. Having said that, its good to have purely for travelling purposes.
If anyone whose PD is earlier than mine, i truly apologize. Its not me, its USCIS. I have seen PDs same as mine getting approved 2 yr ago.

There are 300k Applicants(conservative number) stuck at various stages for immigration relief. All of us want a reasonably fair and a little faster adjudication but none of us want to contribute, raise our voice or be heard.
We are legal-tax paying, high earning, skilled immigrants (would be- permanent residents and future citizens.) who contribute trememdously to this economy, and we are employed by employers who did not find suitable citizens in their cities/counties. NOW!. If we do not organise and get heard! we are the ones to suffer. "squeaqy wheel gets the grease".
Shame on us, If we cannot talk to other people just like us who are stuck, how can we make ourselves heard to the majority at large. IF we are not bold enough to invite our friends to join IV, then maybe we ought to get stuck in this mess.
It is time to act, organise ourselves. Time to invite our friends to join IV and make them aware and encourage them to participate in the activities like writing to editors, raising awareness, joining state chapters and fund raising.
Lets add atleast one more friend.

Regarding my I-485 appln. status - I do remember seeing "Request for Evidence" status before. Currently I see "Request for Evidence Response Review". I see this status change although there are no LUDs.

When USCIS sent you the RFE notice, you would have seen "Request for Evidence". After USCIS receives your response, you would have seen the hard LUD, while the header is still for RFE. Then after some days (with in 60 days), the header changes to "Request for Evidence Response Review", while the old header "Request for Evidence" vanishes. I was in the same boat like you. I spoke to my attorney's team and they offered me the insight glimpse of working of USCIS.

I am confused about what to write in question-31 of DS 156 form.
I came here on student visa in Jan 2001 and currently h-1 approved (not stamped) since March 06.
When I orginally applied for student visa in Oct 2000 I was given probably 221 G. then I reappeared in Dec 2000 and my Student visa were granted.
So on my DS 156 what should I write in question-31 - which ask " Have you ever been refused US visa ? Yes or No?
help from experienced members will solve my confusion.

Hello,
My cousin H1-B has been selected in the lottery, so her H1-B is in process for this year, but her husband's H1-B was approved last year, so he is planning to get H1-B stamped and come here. If she waits for her H1-B to get approved and come then it will be sometime the end of this year. Is it possible that she can come here on H-4 visa while her H1-B is still in process? Need urgent help on this. She has never been to US.
She can come here on H4 while the H1 is in process, but when her H1 is approved, she must go back to her home country and get her stamping done to get the new I-94 at the port of entry.

The wild cards are still the LC substitutions and EB2 to EB3 conversions. Even if a lot of people had to go back to India, is there any estimate on how many of these LC approvals were later sold by the bodyshoppers? Depending on the extent of LC substitution frauds (from what I hear it was rampant) all the calculations and estimates could get completely thrown off. I agree that we should wait for another 2-3 months for the dust to settle. Even the USCIS/DOS should have a good idea of how many cases there are and that will help them control the flow better and that should reflect in the visa bulletins.
Oh Ya, in 2003-4, tons of "Virual Shops" were doing good business and that was covering coast to coast. And that's the problem, you can't tag the numbers to the effect of misdeeds, events bad or good. There was lot of talk aboout Indians going back but you would not find a single legitimate statistical article. but that does not mean we should not count the effect of that event. This mess is so severe, we just can not reasonabley predict based on available statistical data because so many events happened for which nobody has proper statistical data and so you can't tag its counter effects. I give you just recent example of this forum. Here one member Yadabada was just debating based on very logical set and he took the pain to go through all past damn bulletins showing me 2003 bulletins. I draw his attention that "India" was completing missing from the bulletins as "OverSubscribed" categories for most of the year 2003. Why? Now when you start analyzing this in 2007 and if you miss this important observation you start making your prediction base in diverted direction. Even in year 2003 nobody gave it a importance (AILA or whatever). USCIS has as apolicy put India,China,Mexico and Phillipines as "Oversubscribed" categories. Now if you think logically either particular country should have "Current" or some retrogressed date. But how do you interpret a bulletin if USCIS (Allaudin's Chirag) just make one country completely disappeared from the bulletin. Lateral interpretation could be "That country is no more "Oversubscribed" so why the hell it should not be "Current" if not "oversubscribed". USCIS plays this trick time to time. If you see bulletins from 1995, some time you will find China disappeared soem time India disappeared.
The reality is that people started taking bulletins seriously from 2005 only. till 2004 most of us were not giving a damn to those and that is why 2001-2004 lot is paying the price as well.If the cry what we have seen during July 2007, might have been seen during 2003, I guess, probably things may have been little better.

Wow! Lots of advices and opinions. Meanwhile the housing slump is expected to continue well into 2010. I remember many people on this board challenging me last year 'how do you know it will go down', despite me posting the supporting data and the trend. It has gone down and will keep going down until it becomes cheap/affordable. Maybe 2000 price levels?

By affordable, I mean its around 'x' times your (dual) income, you have your green card and you are prepared to live in the US for next 5 years at least (even if there is any family emergency, you don't have any compulsion to sell off your assets and move to India for good). Now, 'x' may mean different for different people but generally people seem to agree x = 3. And I also agree with you that it might happen that american housing is always affordable. Yes, it might but for most middle class in SFO Bay area, when x was 7-10, it wasn't affordable at all!
I completely oppose folks like Slumdog doing something terribly rash (no gc, no prospect of gc within a year, single income with a baby, baby having some health issues and to top it all the burden of a heavy mortgage on the shoulders, god, I think his situation is simply awful...) but the way I read it is that these indeterminate immigration waits are making people throw caution to the winds.
And I don't agree with folks who feel that buying your house is like renting it out simply because it is mortgaged. There is big difference, eventually its get all paid off and you start actually owning it. Secondly, for a lot of people that they can sell it during their retirement and use the sale proceeds to cover the retirement life. There is very good chance real estate would have appreciated over long term. Of course, you are just interested in 'flipping' you are asking for big trouble.

can you file I-485 while living in toronto (outside the country)? I thought you had to be living in US to file I-485......outside the country you can only file through consular processing....can someone clarify?

All that IV wants you to do is contribute atleast $20 bucks, and you dont have to do anything else. Just think of this..the core team might have already spent hundreds of dollars, and VALUABLE QUALITY time talking to people in D.C, organizing meetings etc at the cost of their personal time thay they could have spent with their families and loved ones. You dont have to go that far, just spend 5 minutes to sign up for recurring contributions, and who knows IV might be able to get something that might give you more FREEDOM for you to say good bye to those lousy employers, and live peacefully!

After coming on L visa my new employer applied for my H1 change of status again in 2006 but not for family. Their H4 from 2005 was valid till 2008.
But Now while I am changing my job, New attorney says that my family is out of status and because we did not file H4 for them again.
What is the alternative to bring them in status. They have vaild i-94 from L2 which is valid till 2009 and they have approved h4 from 2005 which is valid till 2008.
Now my new employer have started my H1 transfer. I am thinking that for my family I will apply H4 change of status once my approval comes. Is that Okay or there is any other alternative to bring them in the status.
My family can not travel to India for H4 stamping till the end of this year. My wife will be delivering a baby in October. Will there be any problem for my new born baby for the passport?
