Bill rate? 70/30 basis?? Contract??? I would like the OP to report his employer to DoL. DoL and USCIS will kick both the OP and the employer. It is easy to get carried away saying that the employer is blood sucker etc. But very clearly, you should know that there can't be these kinds of contracts on H1. The employer knows that people who go to them are on thin ice, and so does the employee (employer is there to do business -- he is not running charity).
Maybe you guys want OP to go to DoL so that both the employer and OP get kicked out of this country (that is good for all of us) due to obvious immigration fraud.
To top it, OP goes on an offensive when people point of the bitter truth to him. This site should not promote illegal behavior, anybody seeking advise on these topics should be severely castigated, because they broke the law too (and they know it, just dont want to admit it). Earlier it was 140K times 7% = 9800 with everybody and now it is 90K times 10% = 9000 with most of them gone into new merit based system.

what do you mean? Who are these rest who will go into a new merit-based system? Even if you count only the number of people here who have approved I-140, that alone is enough to delay us for a very long time even with the current quota (140K). Otherwise we would not have had retrogression.

Fact is you can always make smaller contribution using pay pal or make $100 one time contribution in every few months.
You have no intension to make contribution, so just try to find excuses for not contributing.

Maybe, we all need to go to our home countries-and free them from "beloved politicians":-)

He was always wanting to go back to India but because of the conditions of Indians, he was urged to stay back and help them, he actually went back in between and again came back to SA for a more organized effort.
The situation now is different. The Durbin Grassely bill lobbyists are basically doing what has been happening in UK where local population do not want Asian immigrants taking high paying challenging jobs in their own soil. They don't seem to care if these jobs go away because the effect will be long term and as such it is a known fact that in these days, we seldom see the immigrant community having a good cooperation, every immigrant feels that one less immigrant, it is good for him.
This has been happening in every country where highly skilled migrants take job positions in countries like Aus, NZ, UK, Germany etc..
The US system is harder to crack for anti immigrants than these countries. So they follow this slow bleed approach. On the long run their objectives will be met though it would force out high skilled jobs abroad.
One good thing is that developing nations must capitulate on this and make their labor laws good and also copyright laws and patent laws so that innovation and products are developed in developing nations and so called developed nations will bleed technology and innovation.

Guys,
There seems to be little outdated information on this forum.
1. We can not apply for the medicals if you have opted for the CP. You have to do medicals only in the place where your case will be transfered from NVC.
example: If your case is transferred to Chennai consulate. you have to do your medicals in chennai from the list of doctors they provide.
2. Once your I 140 gets approved, your application will be transferred to the NVC for further processing if you opted for the CP.
3. Once NVC receives the approved 140 it will then notify the attorney or yourself with Fee bills to be paid.
4. Once you send the cachiers check for the CP processing, NVC receives the same and send the Packet 3 which is the FORM DS 230 Part 1 to the attorney of records.
5. Once you receive the DS 230 Part 1, you will have to fill that and send it back to NVC.
6. NVC complets the proccessing and will keep the file at NVC until the Priority dates become current.
7. Once it becomes current, NVC forwards the case to the respective consulate for further processing and scheduling of appointments.
8. once the consulate receives the same depending on their appoinment schedule will schedule an appoinment and will go on from there.... issuing the visa..

I have applied for my H1b extension back in April......Have not heard anything yet........once I get my H1b approval, can I apply for H4 extension from inside the country?? (Is that even required if you are already in AOS pending status?)
No, it not required but maintaining H1/H4 status allows person to remain in USA and apply for appeal if, for some reason, I-485 is denied. Otherwise, person is out of status from the date I-485 was denied.

1. Call your embassy.
2. Ask to speak with a Legal Attache / Equivalent
3. Explain the case in your native language.
4. Ask for help. Most foreign embassies are setup to help.
Tell them you are helpless. Dont know where to go. Given them 100% facts. Dont feel shy about the 'gory' details.
Remember, this is in the legal system now. Bulletin board responses from here are not as good as solid legal advice and help.
Next, find a local Chinese / Asian community organization. Google for it. If you cant find one locally, search for ones in big cities like NY, Boston etc and ask them for a reference. These groups are setup to help immigrants in distress. You might find an Asian-friendly or Asian lawyer willing to take up your case, FOR FREE. Just ask.
Finally, stop talking to all your neighbors. You can always reserve the right to file a Civil Rights / Discrimination suit. The American Civil Liberties Union (ACLU) can help. Call them. After you call your embassy.
This can be resolved easily if you have the right people on your side. Got it?

i've had an NRE account and the only way to put money is in $. you can then withdraw the money in $ or Rs, but i haven't heard of being able to fund it with Rs to start with.
i believe that students can also bring a much bigger chunk nowadays, maybe try that track.
also, if the $100K can be brought to the US each yr, why can't parents send it here as a gift, what is the deal with 30%, does someone know?

1. currently i am on H1 and my wife started using EAD. First time i applied EAD and AP for both myself and my wife. Now, i don't want to renew my EAD but just renew my wife's EAD. Is this ok? What happens to my EAD after it expires. Will i be able to renew it in future or will i be able to apply for a fresh EAD based on my pending 485 with out a problem? what will be my status if i renew my wife's EAD alone with out renewing mine. will i still be on valid h1?
It is not a must to renew EAD; if you are not intended to use it in near future, provided you are maintaining you h1b. It won't effect you by extend your spouse EAD.

I agree with most of the posts here ..there have been lot of ideas but everyone needs to be more serious ...IV core has to come up with a new campaign. ultimately the question is do we wait for something to happen or do we try for make things happen ..

it does not matter if you are a homeowner or not ..just participate (USCIS is not going to double check) ..there will be awareness that USCIS is broken just like Brown's FEMA (the person who was in charge during katrina fiasco)...and maybe USCIS will come out with facts. ofcourse some backlash is to be expected since we waited for too long and now we are in recession !! (also Obama is not going to do anything on his own so soon as he has major major problems to solve first)

I agree with your idea. But time might not be ripe. I'm not sure how we can get attention for legal immigration when the economy is so bad. This is like a downtime. We can use this time to strengthen IV as an organization. We need to prepare for war (activism) when there is peace (downtime). I agree with Pappu, we need to spread the word of IV as much as possible. I've to go beyond my friend's circle as most of them have a GC in hand! :D

Lets not hope for results just act. If Gandhi could drive Britishers out of India using this approach, USCIS is also made of human people and sure they will do something to lessen our pains.
I seriously hope that the Director of the USCIS understands our "Gandhigiiri".
We dont want the Americans thinking, "hey lets keep screwing these immigrants and getting stuff like free flowers and free blood from them"
