does this mean that i cannot get a 3 yr extension based on approved I-140 pp? My labor is not pending for 365 days and so I am solely depending on I-140 approval for a 3 yr extension. I am filing i-140 and i-485 concurrently before July 5...will this give me an EAD option even if 140 takes longer to get approved?

Sorry to hear about such cases. We all have to realize one thing here. The employers need us equally bad as we need them (more often than not, not talking about Indian consultancies here). If ever one encounters such racial discrimination and open abuse at the work place, the best recourse is to file a complaint with the higher ups in the HR, start searching for another employer and ditch the current racist employer at the right moment with an appropriate email sent to everyone detailing why the person is leaving at such an important phase of the product development. Yeah, this might sound un-ethical, but sometimes situations do demand such drastic measures to send the right message. That's when all these racist employers would realize the importance of the person that just left the company. Then they can try to fill in the position with their preferred race qualified person and see how difficult that gets!!
Better still, please talk to your friends and family in other parts of the US and find the areas in the US that are cosmopolitan and try to move to those places. Yeah that is very difficult in the short-term, but in the long-run, you would have peace of mind and a good quality of life after making such a move. Fortunately, i am in the Bay area and i have rarely encountered such racial prejudices out here. Just my two cents.

I did not get any justice, the HR was also having the same opinion, was talking about Indians in the company on h1b and all issues associated the and she said she has 14 years of experience dealing with this and knows how to fix this problem. I was kicked out of the company. No look back at all. I pleaded, told her I will take back my complaint and will not complain but no use. They terminated my employment and could never never fill that position again, but the company did not survive for long though.
I moved to desi consulting after that and things started going a lot better with a understanding employer and I am doing better now.
Fellas - watch out, especially those working in BPO etc.. where they have to deal with abusive clients...

We all came here looking for greener pastures. But How many of you think this Country and this Culture is great ? Now think about the Economic Growth - The US is still the most competitive but they are not the Number One anymore.
Or maybe some of us came here precisely for the reasons you mention, seeking greener pastures but fell in love with the openness, informality and the possibilities here :).
A lot of people wait until they get green card and then make a move back home primarily because they are hedging their bets. They hear all those stories about growth and opportunity in India but are not so sure if they will able to fit in after staying away for so many years. Having a green card gives them the opportunity to test the waters so to speak and come back if it does not work out.

this whole thing sucks. USCIS cannot adjudicate even I-131 on time. We have booked our travel tickets after 100 days of Received date of AP renewal application and looks like we have to cancel our tickets and waste $1800. This really blows and its attrocity to the core that USCIS cannot process AP renewals inside 90 days time period and its a shame that they are not answerable to anyone.
Please post your info-pass experience. We are in the same boat. My wife's AP is pending since 6th June 2010.

When you send all the relevant documents to invoke AC21, there is every possibility for the officer to check whether you have an approved EAD or not. In that case there might be a problem. I may not be correct. But to switch to a new employer, you definitely need a EAD card. I switched employers. My new employer asked for work permit(EAD in this case)
Note : Please check with your attorney, I'm just one like you and this is my experience

US economy is designed this way, everyone will get their own share. No one bothers about optimizing the chain and reducing the cost. If they do that whole economy will collapse. I have many times pondered on the strength/power of dollar value and I feel apart from factors like globalization/petro dollars most important factor is America's politics.
No matter who is in the White House, no matter what their domestic politics are, no matter what their agreement(s)/disagreement(s) are they follow a well established strategic template on the International arena always keeping their focus on fortifying their super power status/dollar strength.
Very fact that dollar value is not as low as it should be amidst the current crisis shows the value that dollar is enjoying(when compared to the value of the currencies of other economies that didn't actually collapse as did American economy) may not be the real value but a strategised value.
Watch this video on globalization (if you have not already watched as it was shared on this forum twice) though it's a bit long and seems like exaggeration at few spots(speaker himself says he may be exaggerating or something like that..) it helps one understand few things.

Looks like we are in minority :), I guess people need to be educated about legalities of the immigration system, just because one applies for a green card , or one gets a Green card, he/she does not become part of the country.
Please remember this folks, till you become citizens you are still representing your home country :), and BharatPremi mentioned US of A only expects that you don't indulge in any activities that the government lists as against the US of A, after all we are all here only because the country allowed us in because they perceive there is a need for high skilled labor, letting us contribute and at the same time benefit from this huge economy,we are at their discretion legally, and they can show us the door just as the way it was opened to let us in, just because you are here does not mean you can demand rights :) and call this your home country, that is what the illegals do. I am sorry for sounding so depressing, I witnessed a mass layoff at my company and a lot of my friends (Americans) who are very senior folks were let go, I was spared, somehow that is hurting my conscience, and I am not in a position either to voluntarily give up my job.I want everybody to be happy, and prosper, layoffs reflect the ugly side of capitalism, the weak and old are exploited.

I disagree with logiclife. The Dems had already been in line (even before the elections) with Bush's view of comprehensive immigration reform...they were ready for amnesty for the illegals, whereas Bush's own party wasn't. And this was why CIR was derailed in the House. Please remember that CIR is the only avenue by which legal immigration reform will be acceptable to the Senate, esp. Senators like Specter who is currently Chair of the Senate Judiciary Committee. Of course, at this point in time, it remains to be determined as to who will control the Senate, as VA and MT have not been decided yet.
My personal view, from Washington, DC, is that immigration will come up in the new 110th Congress. Our work will be done, but IV will need its members support and attention for a while.
