I totally second that. Saralayar has raised a very valid issue and its up to IV and core memebers to take it or not. Getting GC should not be the end of the story, we ought to think beyond that. had this GC process been consistant and FIFO, there would not have been any problem with the fact "citizenship after 5 years of GC". Now this GC thing is so screwed up, we might want to include citizen ship issue as well but definitely, at the very lowest priority.
I am happy that many of our high skilled community has understood my idea and supporting this thread. Yes definitely Core IV needs to look into this. You can also include your valid points so that core IV team can consolidate and research on this.

Unfortunately your friend is correct - the alternate I can think is withdraw your present application and file I-140 and I-485 simultaneously now - other please tell whether this will be a good approach for their benefit. Can EB3 file concurrently I 140 and I 485.
On my wife's labor certificate, it is said her position requires a minimum of master degree. But the alternate is bachelor degree plus 2 years' experience. The lawyer has filed I-140 under EB2.
We are worried that this position does not qualify EB2 because we read on the internet that EB2 requires master degree or bachelor plus at least 5 years' progressive experience. We called the lawyer and said we heard from a friend such a case had been denied. She was very busy and just said there was no problem to apply for Eb2, and if we doubt it, we can hire our friend as a lawyer. We are so pissed off.
Can someone help me clarify if this position is qualified for EB2? do we need to change it to Eb3?

This is Great. You dont have to run the entire 10K. You can run part of it and walk the rest. I do that a lot.
This is a link to other races in the DC area: I have never run a race; so I plan on running one of the 5K races in May or June and maybe try one of the 10K races in August. I am sure there are other races abound in summer. If there are others who are apprehensive about running the 10miler (like me).........you might want to try doing something similar.

Looking at the Approval trend, it looks like TSC and NSC are not following the FIFO (Based on PD, ND etc) when approval. More than half of the approvals are after my PD.
Any one has any idea of approximately many EB2-I cases were approved last year in Sept 2008. Because of the out of turn approvals random date approvals I may be loosing chance once again this time.
I had RFE's for my wife's and my I485 way back in March 09 and after we replied to the RFE's and there multiple LUD's and Soft LUD's till 04/14/2009. On 04/04/2009 last Soft LUD was on my Wife's , Daughter (she never got any RFE) and my case and since then no updates. I was assuming that my case is PreAdjudicated and had high hopes.
Once again seeing an inefficient and irresponsible USCIS being unfair...

We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.
Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.
I totally feel for you right now. A lot of people are celebrating the unexpected news, and those that have applied for labor possibly MUCH earlier are still stuck.
Let's hope that the BEC keep to their new revised deadline and the Visa Bulletins remain rosy for you

The reporter doesn't know what he/she is talking about. I have seen a lot of inaccurate information coming from Indian media about visa increases but this has to be the worst one. It not only claims that the visa increase amendment has passed in the Senate but also that minimum wage bill is yet to be considered by the house. This bill was passed by the house in the first 100 hour marathon.
I don't know from where this reporter gets his information from .. may be from immigration-law.com. :)

What people are doing here is basically discounting the value of education. They are questioning the point of going to college at all (or to get a graduate degree), when you can just go to a trade school and learn a programming language that gets you a job. By that logic, why study history, biology, philosophy, languages, etc., if you eventually want to be in the software industry.
What people need to understand is that education gives you perspective. I don't directly use 95% of the education that I gained in many years of school, college and graduate studies. Does that mean it's worthless? I beg to differ, and so do my employers and people who work with me.

A good formal education is always desirable. I have no problem with that. What I take objection to is this entitlement mentality of some folks. A degree does not entitle a person to anything. It may help people get their foot in the door, but then on, they should be judged purely by contribution and merit. This is mostly the case in US and the reason why most Indians do well here. Contrast this to an Indian system and you see all sorts of differentiation going on. An engineering graduate thinks a commerce graduate is dirt. A commerce student thinks a history student is typically retarded. An IAS officer thinks he is GOD :D. A US degree holder (of Indian origin) thinks he should be ahead of immigration line. It goes on...
In all this, we are forgetting the actual person and attaching too much weight to an educational certificate issued by an institute/university. Education is an on going thing. It is good to have formal education, but we often forget universities are not the only sources of education and degree certificates the only credentials. Heck, even USCIS recognizes this :D.
Ladies and gents, if anyone of you have that coveted PhD from Stanford, don't jump into water yet, thinking you can walk on it :D:D

USCIS usually transfer the aplications to differrent service centers to load balance, they did that to applications in 2007 July as well...
Mine was transferred to CA and I got my EAD/AP quickly... then my 485 was transferred back to whereever it belonged...

My question is what will the attorneys and para legals do in the US, if they don't find sufficient cases to sustain their operation? What they studied here is not portable for other countries like software.

I do not understand how dates for India will get worse by processing July/August apps - mostly applicants with Pri dates after June 2003 (EB3) or Apr 2004 (EB2) applied in July/August.
