kudos to what u accomplished in July 2007, but the reality is we haven't seen any major action after that. I guess its mostly frustration from ppl here, who think that the US housing/EB crisis can be pursued aggressively than expecting for CIR to happen.
thanks
Your suggestion to pursue this option gels really well with the below proposal
http://immigrationvoice.org/forum/showthread.php?t=23962&referrerid=15623
To quote realizeit:
"I believe the above proposal is a small step in the eyes of the protectionists where as it is a big leap for all retrogressed country applicants. We may be able to achieve this using administrative fix or an action from the Executing branch, as this won’t change the annual GC quota of 140000. Apart from this, this will encourage all those skilled immigrants to invest in American economy within 1-2 years of filing AOS application. At present most of us are sending our money to our home countries as our situation is so uncertain. This effort will definitely help the ailing economy and will serve as a boost to the housing market."

Interesting analysis.
However with country cap in place and if EB-ROW candidates are in plenty, India and China cannot advance even if visa numbers are available.

Why should ROW always move forward?:D You think just because your numbers are small, we live for free in the US of A.
I don't think you're following it too closely.. every year it creeps up a few early 2005 months, becomes unavailable the last quarter then in October jumps back to late 2003
completely unexplainable monkey business !!

No, it wasn't. The 1999 quota was exhausted in April 1999. Granted this is better than the situation today, but not by much as the quota was larger that year and the economy was smaller.
http://www.murthy.com/arc_news/a_h1quot.html
well i meant pre y2k , april 2009 was the year that indians were bought in for y2k
i have a friend who got an h1b approved in 97 in the last week of aug
They said the results are statistically significant, which means that you can extrapolate to draw conclusions about the entire H1 population.
well i dont know if they actually said that or its your own conclusions but eitherways i do know that most of the peepz working with bodyshoppers have souped resume's or have some shit going on .
when my bro got here to do his masters in 2005 , the masters quota was availble till about july
in about 2 years it became a lottery without the number of student intake doubling/trembling up to make it one
they were body-shoppers running multiple petitions on students through a well run fraud circuit which artificially created a shortage
Not really. They used one example of someone working in a gas station for shock effect. The main complaint from the anti-immigrant side about the report was not that the 20% rate was understated, but that the rate would have been higher if it had included anyone paying a Level 1 wage as well.
again i dont know if thats what the anti-immi's complain about or if thats your own conclusion but the fact is that they're racist and will always have something to cloak around and raise as an issue
but the fact of the matter is that when any fraud is unearthed with connections to the highly skilled worker , the whole "Brand equity" gets badly tarnished , it not only gives the Anti -Immi's more fuel but also sways public opinion in all quadrants
you cant separate the Anti-immi jingoism and the fraud committed through those Desi bodyshoppers ,

Actually...with India growing up fast....i do not know if I am wasting time here.....want to go back .....
If there is no growth in India...then it makes sense to stay here....
https://www.cia.gov/library/publications/the-world-factbook/countrylisting.html
GDP - per capita: India $2,700, US - $46,000
GDP total: $1.09 trillion v. $13.79 trillion
Inflation rate: 5.9% v. 2.7%
growth rate: 8.5% v. 2.2%
It may make sense for you, I am not completely aware of the situation in India. I agree that the situation with GC is bad for EB3 India, but I think there are plenty of opportunities here as well. Just do not base your decision on emotions, keep your cool...

While AP entry officer Stamped date one year back on my I 94 and AP Doc.Which means my stay was already expired before entry . Thank god I verified all dates before leaving counter. He changed it immediately. My advice to guys check it all before you leave counter. You never know which things can come back and haunt you.
you should possibly also carry a copy of the AP application. At least my application clearly stated that travel was for business/personal reasons...
I am sorry you had a bad experience...possibly because of the officer's ignorance...worth a complaint...maybe you can draft something with your lawyer....don't just ignore such bad behavior...
I have travelled on AP and didn't have any problems..although the officer stamped a wrong date (one day earlier) on my passport..talk about incompetence

Following the rules as they are doesn't imply there's no injustice or congress can just shut shop and go home. Giving unused visas from EB1 to EB2 is just following rules as they are - just as giving preference to Non-Indian's first is. I get to meet plenty of EB1 & EB2s who are just plain retards so its not 'obvious' that they're going to 'benefit' the greater society at large though the rules were framed hoping that would be the case. Also, EB3s def. have to be labor certfied so they're not displacing anyone - the whole system is such a mess and is being abused so much that things that ought to be obvious & taken granted for have to be reiterated again & again so its just dumb to say 'EB3 is the least qualified of the three and is also the most likely candidate to displace an American'! And if theres a sudden glut in the labor force and plenty of native born well qualified work force is available, there shouldnt be anyone in the GC queue to begin with so there'd be no reason to do away with any quotas - unless one presumes people will be abusing the system all the time.

US economy is designed this way, everyone will get their own share. No one bothers about optimizing the chain and reducing the cost. If they do that whole economy will collapse. If people started sticking to one marriage and stop taking the divorces, these lawyers will not have work and that portion of economy will collapse. If you have time please watch this video

i do wonder if the poll results from earlier polls if used to compare with the current one would help get an idea of the trend - kind of overlaying the snapshots in different points in time and then determining what the situation was and what is and then extrapolating based on data that is already known/ published by uscis applied to the trend. question is if we have the poll data from earlier polls?
good idea. A google search beings up:
http://immigrationvoice.org/forum/forum2-retrogression-priority-dates-and-visa-bulletins/6128-trying-to-find-where-eb2-india-might-land.html
almost the same sized sample (~450)... this was right before the july 2007 fiasco, but includes 485 not-yet-filed, so is in essence the same thing as this poll.
2003 got somewhat cleaned up (used to be 15% is now 1%)
2004 is more or less same, of slightly higher (98 votes (24%) now. was 84 votes(20%) then)
so looks like big improvement in 2003, but 2004 barely changed overall?

There are limits to everything - and to worries too. Of course you don't want to be taking meaningless risks, but to live like a chicken is not an option either. But this is more philosophical, here is my question.
USCIS may send RFEs for whatever and whoever they think it's reasonable. They can investigate and reinvestigate and GC holders and citizens, it's their job. Now tell me. How many you know of GC holders who got denied their citizenships because they just threw away their W2s? How many GCs were actually revoked and people were deported because USCIS investigated company and found out that most of the employees were H1b?
Here is case of my cousin, he had his GC for many years, his wife and kids got citizenships. He didn't because he didn't accrue his 5 years in the US. He felt that he would be more successful in his home country. So he had business over there and was traveling back and forth to/from US. Once, at airport the immigration officer asked why he was traveling so much? He honestly answered "i'm doing business abroad". What do you think? INS officer initiated investigation and put him on deportation. Reason? "Absence of immigration intent!!!!". The case was quickly dismissed by immigration judge. My cousin was telling me how angry the judge was at prosecutors, he told them not to waste tax money like this anymore. So... what would be the right choice for him? Taking risk and making money (now he has a $1M house in LA) or be "careful" and live in some crappy hollywood apartment until his citizenship?
Very well answered Bestia, I would live like a loin then like chicken, enough of this life...EAD,AC21 is enough for me.

That's not correct. Such frequent reentry after exit will certainly lead to suspicion by an Immigration office at PoE. In fact the intent of 10 year visitor visa is not 10 years of permanent residence. If there is no convincing reason for such frequent reentry you are mostly likely looking at serious interrogation or deportation at the airport. There is no substitute for a GC for your parents if you want them to be with you permanently in the US. Visitor visa has a specific purpose and intent, abusing it could put your folks serious trouble. The other issue with such long term stay on Visitor Visa is - medical insurance - unfortunately there is no good, reliable and comprehensive medical insurance that covers elderly visitors on short trip.
Thanks ! Thats what I thought , but wanted to confirm with senior members.

Hello Gurus,
I am also in the same situation. Last week, My desi employer gave me a deadline to find a project after which he will lay me off. On the same day my concurrently filed I-140(July 07 filed) was approved. I have also applied for EAD renewal. My approved H-1B petition has two more years. Now I am focussed more on finding a full time position. If I get one, should I ask the new company to transfer my H-1B visa or should I be using the EAD once I get it? What do you Gurus recommend? Any information on this will be really helpful for me in making up my mind.

buddy...iv core are not magicians, they have lives too. so please stop asking for more. when you say "iv has the luxury" hopefully you mean all 25,000 who make up iv. the core is not iv. they are just volunteers already breaking their backs...
there are good reasons for the temporary stops to the checks. everything need not be publicly anounced. please leave it at that.
and while we are at it...we need help with the leg work...please complete your profile so we can get you involved with some of it...it would be great to have you as a volunteer!
With all due respect, the probelem I have with volunteers is that I don't think amtures can pull a job this big, you've got to have profesionals, somethng like a compain maneger.
I admire the courage of your guys, and think the goal is fantastic. But the way it goes, I don't see how it can be achieved.
I've learned a great deal about immigration from the forum here. I very much appreciate it. I try to give back by answering questions others may have. I think IV has been doing a great job serving as that capacity.
But you guys want do something bigger. Well, you have faith in it, I don't, at least not now, neither many others. Maybe that is why you are still asking for money and volunteers.
