Providing ability to file AOS (485) without priority dates being current is part of the IV agenda. Nobody is ignoring the plight of those who have been left behind. IV is still working for your cause.
Have patience. There's a funding drive for Recapturing going on right now. It will help you (and others) to file 485. If unused visa numbers are captured dates will become current again, and you can apply for AOS. Given that PDs will jump forward by years in every category you have a good chance of getting GC in a short period of time.

This does raise some valid questions... For instance, what about children from, say, a previous marriage? What about children when the couples are not married? Do the children qualify under FB visa?
I realize this has nothing to do with EB immigration, and that such cases are relatively uncommon. But still, if someone with expertise and experience can comment, it would add to the knowledge base, and who knows, someone might find it extremely useful.

- What does corruption-back-home has to do with it? There is a more open political discourse here. We should either participate and let them know what we want, or they will do whatever they want ( like they tried to reduce EB quota to 90,000 in the last CIR).
- I have been to many lawmaker Offices in Michigan, I have visited several lawmaker offices in DC (both in and out of Michigan). Over that, I went and testified before MI Senate Transportation committee when they were denying Driving Licences to all foreign workers.
If you think they delayed your EAD for 120 days, why do you think they approved mine in 2 months flat, for full 2 years, even synchronizing the expiry date of the EAD with the validity of the new one (meaning, I didn't lose a single day)? May be they were angry that you weren't trying hard enough? :-)

-There are many Americans (even level headed ones) that do not believe that immigrants have any right to push for change in US policy. Regardless of whether it is change for the better, and there is no other constituency to demand improvements. Sheepish looks ensue...)

This is ridiculous. Looks like, They want to increse the fees to collect money for border security, to build the fence on the border. Pretty sure they wouldnt use this money for speedig up the processing times for applications.

Hi all,
Mine is a different situation, i was with my employer till mid of last year and did not inform him while leaving his company and joined another job (h1 transfer) he is now saying that the vendor did not pay him some money and i have to pay that amount and he is demanding that amount for my W-2.
He also said that he would take legal action if i didnot pay his losses ( i did not sign any document with him other than my h1b papers) no agreements,
I am going to call IRS after feb15, but is he going to go to court?
Please suggest me.

As the momentum builds, we need to call in greater numbers to mobilize congressional support in terms of more sponsors. Please CALL per action items. Call now. Ask others to call. Who said the worries stop at GC? When I am on H1, my family could able to go and come back from my home country when ever they want. There was no restriction on how many days they need to stay in US to keep their status valid. Their H4 status is valid as long as I retain my H1.
Now after GC, they are mandated to be present in US for 6 months in a year to retain their GC irrespective of my status and they are not happy about it :(
Some may question what am I doing in IV after GC? Visiting IV is a habit for me and I will be depressed if I don't visit IV for a day :D. I also provide some useful information regarding various immigration issues by learning and passing it on to my friends and relatives and encourage them to come and visit IV by promoting it.
Anyway I am struck to IV even after I got my GC. I hope many fellow IV's will do the same to bring many people who seek immigration under IV :)

Your most compelling argument of preponing your visa interview is that they have opened slots which were not earlier available and you would like to finish this process and keep some time incase some additional documentation was required, you would have the time to get it. Also, there is NO RULE that says you cannot prepone appointment.
Also, I suggested you get a fresh appointment at Mumbai (your original appointment was in Chennai - correct?)

Houston Indian consulate is horrible. Just horrible. They are rude and totally anti-customer friendly. It is unbelieveable how rude they can be. I have tried to contact him numerous times in my last 10 yrs in US and never was I able to get a reply to my emails/faxes or phone calls. I had trouble when i was an indian citizen and had to renew my passport, had trouble when I had to get tourist visa, had trouble when i had to get my indian passport cancelled and trouble when i had to get some misc. services for my daughter. They keep changing rules (example they changed the way they give tourist visas to people of indian origin, they changed the rules and prices to even just surrender the passport).Everytime my only option was to drive all the way to Houston and be at the mercy of their rudeness. I do not see any point in External ministry of india helping because they are equally worse. It sad and dealing with beauracracy is just a part. The whole problem is that they are not accountable. I dont even know whom to complain for the fact that I cannot even get somebody on the phone and have to drive all the way to Houston just to get a minor question answered.

My document uses similar method as used in 2007 USCIS Ombudsman report.

The bottom line is EB limit has enjoyed spillover from unused FB visas and this year it is not going to happen. In the past we have been used to EB limits of 154K (2007), 163K (2008), this year we have to get used to the original limit 140K The movement of PD of various categories would take their own coarse based on USCIS interpretation of spillover between categories.
It would be great if members can update their profiles so that IV can do a better job of estimating the forward movement using the tracker.

there are motivated members who cannot come for genuine reasons. we are trying to help them where we can- and they are helping others where they can. but they are far outnumbered by the "this is a forum if you don't want tracking why don't you close it" crowd. and the "who are you to ask me" crowd and " participation is voluntary, don't spam me" crowd- you know the drill.
apparently many have forgotten or never bothered to find out that IV is a grassroots organization that aims to end all retrogression. and they have a distaste for education too. after all they are "highly skilled" :confused:

Now, IV doesn't have control over the schedule followed by the US congress. Having said that, let me assure you that there is positive movement. If you look at recent posts by other members, you will see that momentum. That is the result of your efforts with DC rally and your contribution.
This last quarter of 2007 is do or die for us. That is why we are asking members to join state chapters and preparing for our next big push. All this may not be what you would be hoping for but guess what, without your efforts we wouldn't have come so far. So have some more patience.
